GRASS CUTTING
Under the Town of Arborg's Unsightly By-law No. 3-2001, Section 3 stipulates "no owner of occupier of property shall permit on such property, and each owner and occupier of property shall keep such property free and clear of:
(h) the growth of weeds as defined in The Noxious Weed Act so that the same become a nuisance to adjoining properties; and
(i) the growth of grass to a length which in the opinion of the designated officer is unsightly."
Complaints & Inspections
A written complain must be filed with the designation officer. Upon receipt of a written complaint, the designated officer will inspect the property alleged to be in violation.
Warnings & Orders
If, in the opinion of the designated officer, a property is determined to be in violation of By-law No. 3-2001, a written notice of the violation may be sent to the owner and occupier of the property by regular mail. If the violation continues following a warning notice, the designated officer shall issue a written order. The designated officer may, at their discretion, not provide a warning notice and instead provide a written order.
Appeals
Any person wishing to appeal an order made by the designated officer, may do so by filing with the Chief Administrative Officer (CAO) of the Town of Arborg at any time before the time for compliance. Appeals must be made substantially in the form as per Schedule C of By-law No. 3-2001.
Enforcement
The costs of actions or measures taken by the Municipality to carry of the terms of an order issued by the designated officer are an amount owing to the Town of Arborg by the owner of the property. In addition to all other rights of collection which the Town may have at law, such amounts may be collected by the Town in the same manner as a tax may be collected or enforced under The Municipal Act.
SNOW REMOVAL
The Town of Arborg has implemented a Snow Clearing and Removal Policy.
The following shall be prioritized:
- Emergency Routes
- Main Thoroughfares including Public Parking Lots;
- Although Main Street is under the authority of Manitoba Infrastructure, by agreement between the Province and the Town, Arborg is responsible for the snow clearing operations on Main Street from River Road to Third Avenue;
- Residential Areas;
- Recreation Centre
The public's cooperation in keeping vehicles off the streets during snow clearing operations is required. Vehicles left on the street may be towed at the owner's expense.
Maintenance Responsibilities
Following a snowfall, initiation of snow clearing and removal will be at the discretion of the Public Works Foreman and/or the Public Works Committee. Town streets and parking lots will be cleared as soon as possible.
During continued storm events, emergency and business routes may be opened again prior to proceeding with the residential and recreation centre. Snow hauling will occur as required, in particular from areas where visibility may be hindered by snow piles, as well as from major drainage areas.
Windrows of snow left behind on driveways by the municipal grader shall be removed by the Town's loader and teh Town will remove the windrows of snow left on driveways by Manitoba Infrastructure on the streets they maintain. This will, however, be done as time allows.
Street sanding will be done as required. Arborg's sidewalks and walkways will be cleared with a Trackless Municipal Tractor with attachments.
*Extension cords are not allowed across any sidewalk or walkway.
Businesses and Institutions
Pushing or blowing of snow from any business of institutional property onto the Town's streets, ditches, sidewalks, right-of-way or property is prohibited. Snow must be kept within the business or institutional property or hauled away at the owner's expense. Any additional cost incurred by the Town as a result of policy contravention may be charged back to the business owner or landowner. Snow contained on business or institutional property shall be piled so as to not hinder visibility for traffic.
The Town shall have a designated site where hauled snow can be deposited with the permission of the Town's Public Works Foreman. Contractors utilizing this site are responsible for pushing the hauled snow into a pile.
Every owner, occupant or person having charge or care of a business or institutional premises fronting or abutting on any street or public place within the Town of Arborg shall:
- Exercise due diligence to ensure safe passage of sidewalk pedestrian traffic by applying an ice melt product on the sidewalk fronting the premises when necessary;
- Not allow snow removed from roofs to remain on the sidewalks, curbs or walkways. This snow amount must immediately be hauled away at the expense of the owner, occupant or person having charge or care of the premises.
Residential
Residential property owners/tenants shall refrain from pushing or blowing snow onto the Town's streets, ditches, sidewalks, boulevards or any Town Right-of-Way. Snow should be kept within the residential property or hauled away at the expense of the owner/tenant. Snow contained on residential property shall be piled so as to not hinder visibility for traffic. Any additional cost incurred by the Town as a result of policy contravention may be charged back to the property owner/tenant.
